1) Consoles do have a lot of indies. Journey, Lone Survivor, 1 M4D3 4 G4M3 W1TH Z0MB135 1N 1T, etc.
2) Consoles can run emulators, believe it or not. I have Gameboy and N64 emulators on my PSP! They run nicely too. If I wanted to jailbreak my PS3, I'd get emulators on it too.
3) Believe it or not: Consoles do have a few mods. Not AS many as PC, but it still has some mods for games like Skyrim or Minecraft. Look it up.
Honestly, those points you made are pretty moot.
