I would think that the countries that have harsh punishments dont have a "social System" as in everyone is on their own and countries that dont have harsh punishments have a social System. I find it quite strange though as a state with absolutely no Police and law would fall into anarchy. Just checked statistics for crime rates in the US from 1900 to 2010, curiosly this follows condratiev cycles. Cant really say that it is coupled with the economy.... unless you dont Count the modern crisis as a crisis. Lowest crime rate is for 1900.

Well some Psychos can be uncovered fairly quickly others may have mastered their practice and be masters of deception. However it is not very probable that a innocent Person is sentenced to death for Serial killing (either DNA evidence required or witnesses linking him to most of the murder Locations + the murders will probablly Keep going if the Person is innocent.) For single murders you are right it is possible that innocent People go to death row I couldnt find any numbers and compare them with fallback percentages though. The idea of death row is not only to kill the People but to scare them from ever even commiting a murder.

If I am honest the above is not enough I believe that Society itself has to be reverted a bit, as in parents raise their children not daycares if a child does something bad a simple wagging of the finger wont help you Need harder punishments to prevent it from Happening again, however People Need to use some common sense you only Need to scare a child when you hit it not injure him!
Same is true for teachers. Then once These People enter Society they will be conditioned to follow the rules. Then by using harsher punishments for crimes you can really Keep your People in line.
